"Capitalskitchen.com" is a trading name of Dephna Impex Ltd, a company registered in England and Wales registration no. 2033302 "Order" means order that has been sent to you to capitalskitchen.com that you have the authority to bind that entity to this User Agreement.
2.	Please read the following terms and conditions carefully. By using this website and placing an order with us you are agreeing to the conditions that appear below. These terms and conditions were last updated on 22nd October 2009. From time to time we may modify the conditions so please continue to review the conditions of use whenever accessing or using this site. 	Provision of the Services by Capitals Kitchen
1.	You acknowledge and agree that caterers from our website will be entitled to provide the Services to you.
2.	You acknowledge and agree that capitalskitchen.com may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at sole discretion without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform Capitalskitchen.com when you stop using the Services.
3.	You acknowledge and agree that we have no responsibility for the information provided by the caterers menu on our website. While we list the caterers menu we cannot take responsibility for allergies or health requirements. Should you require assistance regarding dietary requirement contact the caterer directly.
4.	In ordering from us you acknowledge that we cannot be responsible for defects, delayed delivery times, incorrect products, products stolen, quality of product, ingredients used and prices. Should you require assistance contact the individual caterer if problems arise.
	Indemnity
1.	You will indemnify us against any loss, damage or cost incurred by us arising out of your use of the Site, any of its services or any information accessible over or through the Site, including information obtained from linked sites, your submission or transmission of information or material on or through the Site or your violation of these Terms & Conditions or any other laws, regulations and rules. You will also indemnify against any claims that information or material which you have submitted to us is in violation of any law or in breach of any third party rights (including, but not limited to, claims in respect of defamation, invasion of privacy, breach of confidence, infringement of copyright or infringement of any other intellectual property right). We reserve the right to exclusively defend and control any claims arising from the above and any such indemnification matters and that you will fully cooperate with us in any such defences.
	Payment
1.	We reserve the right to suspend deliveries to you and/or terminate our agreement with you if we are refused authority from your card issuer for payment or we reasonably believe that payment will be refused. You agree to compensate us in full against any and all reasonable costs and expenses (including reasonably legal costs) that we may incur in obtaining payments due from you that you have not made in accordance with your agreement with us as set out in these terms and conditions.
2.	If a payment has been rejected by your bank, you will not be able to amend, cancel or add to your order via our website. You must contact us to arrange payment and wait for that payment to go through before you can made changes to your order through the website again. You can, however, change orders by calling or emailing us (contact details are on the website) during office hours and subject to our order deadlines.
3.	All payments must be placed in advance, unless expressly agreed in writing by us. We reserve the right to charge interest on late payments at the rate of 8% per annum above the base rate of the Bank of England in force from time to time from the due date until the date of payments after as well as before judgment. You may not withhold payment of any invoice or other amount due to us by reason of any right of set off or counterclaim which you may have or allege to have for any reason whatever.
4.	Please note that prices may alter, and that we reserve the right to change prices without prior notice.
	Availability of the website
1.	Although Capitalskitchen.com aims to offer you the best service possible, we make no promise that our website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs with the service, please report it to us as soon as possible using the contact details on our website and we will correct the fault as soon as we reasonably can.
2.	Your access to the website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. In the event that our website is unavailable, our usual order and cancellation deadlines apply. Please notify us of charges to your order by using the contact details on the website.
	Warranties
1.	While we try to ensure that material included on the website or any other material is correct, we cannot accept responsibility if, despite our endeavours, this is not the case.
